Who can place a mechanic's lien?

A garage or marina owner that has repaired, towed, stored a vehicle or watercraft has the right to place a mechanic's lien as long as the vehicle or watercraft has been in thier establishment for a period of over 30 days and its owner has made no effort to pay the charges due to the establishment.

What happens to the personal property left in the vehicle?

|
No lien shall attach to any personal property left in or out of the vehicle. Personal property shall be givin to the current registered owner or the owner's authorized agent upon demand.

Who can authorize a storage or possession lien?
|
|
Any person has a lien dependent upon possession for the compensation which the person is legally entitled...of any vehicle or watercraft that has been authorized to be removed by a public agency, private owner, person in lawful possession of the property, or lessee, operator, or registered owner of the vehicle or watercraft.

How much can I charge for storage?
|
|
Although the Vehicle Code is silent regarding storage rates, you should be able to defend the rates you charge. You should document your rates and whether the vehicle or watercraft is inside or outside, protected or not (in a fence or locked gate or on a vacant lot). Businesses should also have a posted rate sign stating the storage cost.

How do I determine the value of the vehicle?
|
|
The Vehicle Code is silent about vehicle valuation on storage liens. Vehicle value depends on the make, model, and year manufactured, condition of the vehicle and the location. Although the Kelly Blue Book give price guides it doesn't cover the difference in locations, as is condition of the vehicle, and other factors that can effect the vehicles price. We suggest checking your local newspaper.
